Creating Contracts

I am working for a new theater company going into its second season.  It is a small company and I was given the task of creating contracts so that some issues that came up last year does not happen again and to protect the company and actors.  My experience is in community and educational theater where there is little contract use. 

I have been on the actors equity site and been searching through some of the contracts and rules listed there.  But I would to know if any of you have some advice for me.  If you had the opportunity to write a contract what would you include/improve on/delete?  Some of the things that I know have to be addressed are stage combat, housing, and touring.

You're talking about work agreements, correct? Job responsibilities and the like for a particular person or position. If that's the case, I would be happy to email a sample work agreement that I signed before I signed my AEA contract for reference. I may even have more than one type of these agreements. The last non-union contract I was on spelled out the following things for me:

start and end dates
payment schedule
job duties
who I report to
workers comp and liability insurance coverage
promised I wouldn't work on other projects that would interfere
termination terms
things I would be reimbursed for
transportation/per diem issues

For what it's worth, the old non-union contract I used back in the day is available on the Uploaded Forms board.  I inherited it from a fellow SM, who'd had it drafted by an attorney.

All of this helps a lot.  My next big task is to figure out if actors are employees or independent contractors.
